All services provided by MyWorks Hosting Inc may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, unlicensed software or files, or material protected by trade secret and other statue. The subscriber agrees to indemnify and hold harmless MyWorks Hosting from any claims resulting from the use of the service that damages the subscriber or any other party.

MyWorks Hosting will be the sole arbiter as to what constitutes a violation of this provision.
MyWorks Hosting Inc does allow our clients to install their own chat rooms. However, these tend to be large system hogs and may fall into the usage limitations clause. You are free to run your own chat script, as long as it does not hinder server performance.
IRC, Telnet & SSH (Shared Hosting Only)
MyWorks Hosting Inc does not allow IRC or IRC bots to be operated on our servers. Hosting any sort of IRC channel, bot, or relay will result in the immediate termination of your account without refund. Anyone found hosting such files will be held financially responsible for any damage caused to our servers..
Please contact our support department to request SSH access. All SSH activity is logged and reviewed frequently. Access may be revoked at any time.
Spamming, or the sending of unsolicited email, from an MyWorks Hosting server or using an email address that is maintained on an MyWorks Hosting machine, is STRICTLY prohibited. MyWorks Hosting will be the sole arbiter as to what constitutes a violation of this provision. Opt-In email is acceptable, as long as opt-out/removal request are fully honored. Please make an effort to limit outgoing mail on your account to no more than 600 pieces per hour. Large mailings are preferred to be sent from the hours of 12AM – 5AM Central Time. By contracting to a server rental agreement with us and agreeing to these terms, you understand that if spam is found coming from a server you rent from us, it is at our discretion to immediately terminate your server and you agree and understand that no refund will be issued. At our discretion, a warning may be issued to you instead.
Any attempts, whether intentional or accidental (runaway processes or excessive resource usage caused by poorly written scripts), to undermine or cause harm to an MyWorks Hosting server or customer of MyWorks Hosting is strictly prohibited. MyWorks Hosting may terminate any account believed to be abusing the network without warning. Web-based games are allowed on our server; however, if these games affect the performance of the entire server, we reserve the right to suspend the account. If the web-based game results in 2 or more account suspensions based on excessive resource usage, we WILL terminate the account without a refund.
Data Security & Backups
Data stored on the internet is not secure; even the most complex of password protection or encryption services can be hacked. You are responsible for protecting sensitive data, and under no circumstances should confidential information such as credit card numbers be stored on your hosting account. Although daily backups are taken of data stored on MyWorks Hosting Inc servers, we do not guarantee the security of your data in unforeseen events such as a server being hacked. You are responsible for creating backup copies of your work so that it may be restored in an emergency. In the event of a problem backups may be provided to the client if a backup exists, do not rely on this service for your critical data.
Violation of these terms and conditions is grounds for account suspension or de-activation. MyWorks Hosting Inc reserves the right to remove any account without prior notice. If MyWorks Hosting Inc deactivates your account(s) for violating our TOS, your will forfeit your rights to a refund. Warnings will be issued in most cases, but more serious violations can result in immediate suspension or termination of the account. MyWorks Hosting is not responsible for data integrity, regardless of circumstance. We strongly recommends keeping up to date and off network backups to protect against data loss. A 10% late fee will be added to all overdue invoices.
Refunds / Cancellations (Shared Hosting)
With each hosting account comes an incredible peace of mind; you can request a complete refund within the first 7 days of service if you are not completely satisfied. However, if you decide that you would like to cancel your service, you must contact a customer service representative WITHIN 7 days from the signup date for your service. If you wish to keep the service, no action is required on your part; our system will continue billing you after the 7 day refund period unless you cancel within that time. If you don’t contact us to request a refund or support, and simply open a dispute or chargeback, you are in violation of these terms and you may forfeit a refund entirely. We strive to guarantee 100% customer service, and we can’t facilitate that if you don’t communicate with us. If you violate any portion of this TOS/AUP, you immediately forfeit your right to claim a refund. Hosting cancellations must be submitted 10 days before the next renewal date of the hosting plan. No exceptions can be made.
Refunds / Cancellations (Dedicated Servers)
Dedicated servers have a 5 day refund period if you are not satisfied with our services. However, if you decide that you would like to cancel your service and would like a refund, you must contact a customer service representative WITHIN 5 days from the signup date for your service. If you wish to keep the service, no action is required on your part. Server cancellations must be submitted at least 10 days before the next renewal date of the hosting plan. No exceptions can be made, and service will continue for another plan cycle if cancellation notice is put in within 9 days of the server renewal date
No Services rendered by MyWorks Hosting are eligible for a refund (except those implied above). Prepayments and account credit are ineligible to be refunded, or transferred to alternate accounts. Any and all charge disputes must be reported directly to MyWorks Hosting within thirty (30) days of the date which the charge originally occurred. If a charge which is deemed valid by MyWorks Hosting, and validated by our Terms of Service, is disputed to a financial institution by performing a charge-back, then you as a client agree to pay an ‘Administrative Fee’ of $200 in addition to original amount of funds which were reclaimed.
By placing an order through our system, you check the box and thereby agree to these terms, any chargebacks opened are subject to arbitration through us and not your card company.
Changes To This TOS/AUP
MyWorks Hosting reserves the right to change this TOS without warning, though major changes may be communicated via e-mail.
